Online Booking Terms

By proceeding with a booking, paying a deposit, or otherwise engaging CNG Contracting (“CNG”, “we”, “us”, “our”), you (“the Client”) expressly acknowledge and accept these Terms & Conditions. Your actions also signify your consent to our Privacy Policy and agreement with the online booking authorization language as displayed on our website. Where a separate signed contract exists, its written terms will take precedence only to the extent that they expressly modify these Terms.
1. Definitions & Scope
- Handyman Services: Repair, adjustment, installation, and maintenance tasks completed within a single visit or short duration (typically two to four hours).
- Major Renovations or Projects: Multi-day or multi-trade undertakings involving construction, structural improvements, or work requiring permits. Includes material procurement, subcontractors, and phased billing.
- These Terms apply to all residential and commercial work carried out by CNG within Ontario, unless a written contract expressly modifies them.
2. Company Policy (General)
- Compliance: All work complies with the Ontario Occupational Health & Safety Act, Building Code Act, and any applicable municipal permit requirements.
- Insurance: CNG maintains commercial general liability and business insurance. Clients must maintain their own property insurance for pre-existing conditions or third-party claims.
- Professional Conduct: All CNG staff and subcontractors must act professionally and protect client property. Any concerns may be reported to info@cngcontracting.com.
3. Privacy & Data (PIPEDA / Ontario)
CNG collects personal information (name, contact details, property address, payment info, project details, and photos) only as required to manage services, permits, and billing. Data is disclosed solely to personnel, subcontractors, municipal authorities, or payment processors directly involved in the project. CNG does not sell or rent personal data. All data is safeguarded, retained as required by law, and securely destroyed thereafter. Clients may request access or correction by contacting info@cngcontracting.com.
4. Booking, Estimates & Quotes
- Written estimates or quotes are valid for fifteen (15) days unless otherwise stated.
- Acceptance of these Terms occurs when the Client checks the consent box and submits payment for the booking or deposit.
- Online booking requires: full name, email, phone, service address, description of work, preferred appointment window, and billing details.
5. Payment, Deposits & Final Invoices
- Handyman Bookings: Require a booking fee of $250 + HST ($282.50 total). This covers scheduling, travel, and a standard call of labour.
- Major Renovations: Require a deposit of 30%–50% of project value before procurement or scheduling begins.
- Payment Terms: Payment is due immediately upon substantial completion of work unless otherwise agreed in writing.
- Deposit Policy: Deposits are non-refundable once received and applied toward the final invoice balance.
- Accepted Payments: E-transfer (info@cngcontracting.com), cheque, or credit card (processing fees may apply).
- Overdue accounts may incur collection fees or liens under the Ontario Construction Act.
6. Cancellation & Non-Refund Policy
- Handyman Services: The $250 + HST booking fee is non-refundable. Cancellations over 24 hours before the appointment receive a $182.50 refund (CNG retains $100). Cancellations within 24 hours or no-shows receive no refund.
- Major Renovations: Deposits become fully non-refundable once procurement, permits, or scheduling begin. Cancellations within 10 days of start date incur an $800 closing fee plus costs of materials and permits. Restocking fees (35% + tax) apply to returnable materials.
- Obligation: Clients remain responsible for all costs incurred by CNG up to cancellation.
- Refunds: Where applicable, refunds are issued within 14 business days to the original payment method after deducting applicable fees.
7. Scope Changes, Variations & Extra Work
Any change to the original scope must be approved in writing (email or signed change order). Additional work is billed separately and may require further deposits. Hidden or unforeseen issues (e.g., structural damage, mould) discovered during work will be assessed and priced before proceeding.
8. Warranties, Defects & Limitations
- Labour Warranty: 30 days from completion for all work by CNG.
- Materials Supplied by CNG: 30-day warranty from completion.
- Renovation Division: 2-year warranty for plumbing, electrical, and HVAC services.
- Exclusions: No warranty on client-supplied materials, third-party modifications, pre-existing issues, or normal wear and tear.
- CNG’s obligation for valid warranty claims is limited to repair, replacement, or refund (per Section 9 liability cap).
9. Limitation of Liability, Indemnity & Liability Cap
- Liability Cap: CNG’s total liability shall not exceed 10% of the total payments made by the Client for that service or project.
- Exclusion: CNG is not liable for indirect, incidental, punitive, or consequential damages (including loss of use, profits, or property value).
- Indemnity: Clients agree to indemnify CNG against claims resulting from client-supplied materials, incorrect information, or third-party work.
- Insurance: The existence of insurance does not expand CNG’s liability beyond these limits.
10. Dispute Resolution — Mediation & Arbitration
- Disputes should first be resolved through good-faith negotiation and site inspection.
- If unresolved after 30 days, disputes proceed to binding mediation or arbitration under Ontario’s Arbitration Act, 1991.
- Parties waive court and jury trials to the extent permitted by law. Consumer statutory rights remain unaffected.
- Each party bears its own mediation costs; arbitration costs are assigned by the arbitrator.
11. Termination & Site Access
- Termination: CNG may suspend or terminate services for non-payment, unsafe conditions, or breach of these Terms.
- Site Conditions: Clients must provide safe access and remove valuables before work begins.
- Subcontractors: CNG may engage subcontractors but remains responsible for their compliance under Ontario law.
12. Third-Party Products, Suppliers & Permits
- CNG disclaims liability for defects or incompatibility in client-supplied materials.
- Clients are responsible for paying all permit fees unless otherwise agreed.
- CNG can assist with permits and inspections for a $250 + HST administration fee.
- Delays caused by municipal or regulatory authorities are considered excused delays.
13. Miscellaneous
- If any clause is invalid or unenforceable, the remainder remains effective.
- These Terms, along with any written estimate or contract, constitute the entire agreement between the parties.
- CNG may assign rights to an affiliate or successor; Clients require written consent to assign theirs.
- Official notices should be sent to info@cngcontracting.com or the company’s physical address.
- The English version governs in case of translation discrepancies.
14. Acknowledgment & Acceptance
By paying a deposit or directing CNG to begin work, the Client confirms full understanding and acceptance of these Terms, including limitations of liability, cancellation provisions, and dispute resolution methods.
15. Final Legal Disclaimer
This document is intended to protect all parties but does not replace legal advice. Certain consumer rights under Ontario law cannot be excluded or modified by contract.
